Style Rewards Program – Terms & Conditions

Style Rewards Program Overview
• 1. Effective as of October 4th, 2016 (the “Program Start Date”), the Style Rewards Program (referred to as the “Program”) came into effect. The Program is a customer loyalty program offered by Laura and Melanie Lyne, divisions of Laura’s Shoppe (P.V.). Inc. (also known as Laura Canada), to customers of participating Laura and Melanie Lyne stores (the “Stores” or each individually a “Store”). The following terms and conditions govern the Program.
• 2. Laura and Melanie Lyne may, in their sole discretion, restrict, suspend, amend, extend or otherwise alter the terms and conditions relating to the Program (including earning and redemption rates) at any time, from time to time, and without prior notice. If the terms and conditions have been updated, Laura and Melanie Lyne will post the new terms and conditions on the Laura and Melanie Lyne websites (the “Websites”) and note the date that they were last updated. We encourage you, as Members (as defined below), to review the terms and conditions relating to the Program each time you visit the Laura and Melanie Lyne websites and/or shop at Laura and Melanie Lyne. Notwithstanding the foregoing, Laura and Melanie Lyne may, in their sole discretion, terminate all or any part of the Program at any time with 30 days’ prior notice.
• 3. Where notice is to be provided pursuant to any section of these terms and conditions, it will be made via notices posted in Stores and/or a notice posted on the Websites, as determined by Laura and Melanie Lyne in their sole discretion.
Style Rewards Program Membership
• 4. Registering in the Laura and Melanie Lyne Database: To participate in the Program, you must be registered in the Laura and Melanie Lyne customer database. In order to become a member of the Program (each, a “Program Member” or “Member”), you must qualify for membership (“Program Membership”) in the manner set out below.
• As a new customer, you can enroll in the Laura and Melanie Lyne database at any participating Store or online, and an account (“Account”) will automatically be set up for your purchases to be tallied towards Program eligibility as of your registration date.
• Only one Laura and Melanie Lyne database record or Program Membership is available per customer. Only an individual customer may become a Program Member. If any additional family members or others domiciled with you wish to participate in the Program, they must each register for their own personal Account.
• Points may not be combined or transferred for the purpose of eligibility in the Program and/or for the purposes of earning Style Rewards. Only the registered holder of each Account is eligible to earn Style Rewards from that Account. If you wish to opt-out of the Program, you may do so by calling Customer Service toll-free at 1-877-973-8638.
• 5. Qualifying for Insider Membership: After registering in the Laura and Melanie Lyne database, you will become eligible for the entry level tier Program Membership with no minimum to spend. Once you become a Member, you will be eligible to receive loyalty benefits and earn Style Rewards.
• Qualifying for Luxe Membership: As a Member, when you earn between 900 and 1,799 points on eligible purchases, at participating Stores, in a 12-month period, you will automatically advance to the Loyalty Luxe level and receive additional Luxe benefits and also be eligible to earn Style Rewards.
• Qualifying for Elite Membership: As a Member, when you earn 1,800 or more points on eligible purchases, at participating Stores, in a 12-month period, you will automatically advance to the Elite level and receive additional Elite benefits and also be eligible to earn Style Rewards.
• As a member, you are entitled to receive either Insider, Luxe or Elite level benefits for 12 months from the month in which you qualified for the Insider, Luxe or Elite levels.
• Eligible Merchandise includes any merchandise purchased at a Participating Store with the exception of Laura or Melanie Lyne gift cards. Your points balance includes points earned on purchases made with a Laura or Melanie Lyne gift card at a participating Store.
• Program membership is granted at the sole discretion of Laura and Melanie Lyne, and may be withdrawn or suspended at the sole discretion of Laura and Melanie Lyne with or without notice and without liability to Laura and Melanie Lyne. See Rule 7 for more information.
Requalification for Style Rewards Membership Status
• 6. 6. During the 12-month membership period, you will automatically requalify for Insider level. You must requalify to the Luxe tier by earning between 900 and 1,799 points on eligible purchases, in participating Stores, to receive Luxe benefits for another year, or a minimum of 1,800 points to receive Elite benefits for another year. If as a Luxe or Elite Member you do not requalify, you will requalify at the Style Rewards Insider level.
• Example: If you qualify as an Elite tier with a membership start date of January 1, 2017 by earning a minimum of 1,800 points on eligible purchases, in participating Stores, you will receive Elite-level loyalty benefits and be eligible to earn Style Rewards until December 31, 2017. During this 12-month membership period, you must requalify by earning a minimum of 1,800 points on eligible purchases, in participating Stores to continue receiving Elite-level loyalty benefits and be eligible to earn Style Rewards beginning January 1, 2018. If you do not requalify, you will either drop to the Luxe level, if you have earned between 900 and 1,799 points on eligible purchases, in participating Stores, or the Insider level if you have earned under 900 points.
• 7. If Laura and Melanie Lyne determine that you have abused any of the Program’s privileges and benefits, failed to comply with any of these terms and conditions, or made any misrepresentation to Laura and Melanie Lyne, Laura and Melanie Lyne may, in their sole discretion, take such actions as they deem appropriate, including without limitation, suspending your privileges and benefits under the Program, revoking any or all of the Style Rewards earned in your Account, and/or revoking Membership in the Program, in each case, with or without advance notice to you and without liability to Laura and Melanie Lyne.
• 8. Many of the Program benefits are delivered by direct mail and/or email. You must advise Laura and Melanie Lyne immediately of any change to your mailing address or email address by emailing Customer Service, by calling Customer Service at 1-877-973-8638, by going online or by visiting a participating Store.
Earning Style Rewards
• 9. As a member, you earn 1 Point for every $1 spent on eligible purchases in store & online at Laura or Melanie Lyne, provided that you are identified as the Member at the time of purchase. The Style Rewards will be earned in the Account associated with you. Eligible purchases exclude purchases of Laura or Melanie Lyne gift cards, as well as any amount spent using loyalty tender (Style Rewards) as a method of payment.
• 10. 10. Points and/or Style Rewards earned are not transferable or assignable. You may not combine points and/or Style Rewards in your Account with those in Accounts held by other Members. Points and/or Style Rewards accrued cannot be inherited through the will of a deceased member or otherwise assigned or transferred in any way.
• 11. All points earned on eligible purchases, if not converted towards the issuance of a Style Reward, will expire 12 months after the date earned.
Issuance of Style Rewards
• 12. Style Reward notifications will be automatically mailed and/or emailed two months following the month in which you earn your Style Rewards. Style Rewards are issued based on your accumulation of points on purchases made at participating Stores during the applicable 12-month period). Purchases of Laura or Melanie Lyne gift cards are excluded. See Rule 9 for more information.
Style Rewards are Subject to the Following Terms and Conditions:
• Style Rewards are valid from the date of issuance indicated on the rewards, until the expiry date indicated.
• Style Rewards may be redeemed only by the person whose name appears on them, and are not transferable. A personal photo ID may be requested upon redemption.
• Style Rewards may be redeemed only at participating Stores.
• Style Rewards may not be used for the purchase of Laura or Melanie Lyne gift cards.
• Style Rewards can be redeemed during their validity until the entire balance has been used.
• If the full amount of the Style Rewards is not used in a single transaction, the balance will carry over until the expiry date.
• Style Rewards have no cash redemption value.
• If an item purchased with Style Rewards is returned, a refund will be issued for the amount you paid and the Style Rewards’ amount will be credited. The original expiration date of the Style Rewards will apply to the credited amount.
• 13. Laura and Melanie Lyne collect your personal information such as your name, address, telephone number, birth date, email address and purchase information when you register in our database at a participating Store. When you provide Laura and Melanie Lyne with your personal information, we inform you as to why we are collecting it and obtain your verbal consent. In some instances, where the purpose of collection is obvious and the law permits, your consent is implied.
• When you register in the Laura and Melanie Lyne database and/or become a Member, Laura and Melanie Lyne only use your personal information for the purposes of providing you with information concerning its business, products, services and promotions, as well as marketing and administering the Program. Your personal information is not shared with other companies or disclosed to any third parties, except for the purposes stated herein or as permitted or required by law. Laura and Melanie Lyne strive to ensure that our security measures protect against loss, theft and unauthorized access of your personal information.
• You can withdraw your consent for the use of your personal information at any time by contacting Customer Service at 1-877-973-8638 or sending an email. Opting out will cancel your participation in the Program, however you can still choose to receive marketing information and communications not related to the program.
Acceptance of Terms and Conditions
• 15. Except as specifically outlined herein, these terms and conditions represent the only agreement between you and Laura and Melanie Lyne in connection with the Style Rewards Program and supersede all prior agreements, understandings, negotiations and discussions, whether oral or written. There are no representations, warranties, covenants, conditions or other agreements, express or implied, collateral, statutory or otherwise, including implied warranties or conditions of merchantability or fitness for a particular purpose, between you and Laura and Melanie Lyne in connection with the Program, except as specifically set forth in these terms and conditions. If any provision in these terms and conditions is determined to be illegal, invalid or unenforceable, that provision will be severed and the remaining provisions shall remain in full force and effect.
• These terms and conditions shall be governed by the laws of the Province of Quebec and the laws of Canada applicable therein, and all Members attorn to the exclusive jurisdiction of the courts of the Province of Quebec. Any proceedings relating to matters regarding the Style Rewards Program shall be brought exclusively in the courts of the District of Montreal in the Province of Quebec and orders of such Quebec courts shall be binding on Laura and Melanie Lyne, as well as Program Members. Otherwise, all decisions regarding the interpretation of these terms and conditions and the administration of the Style Rewards program, and any disputes arising there from, shall be resolved by Laura and Melanie Lyne in their sole discretion. All such decisions shall be final and binding on all Program Members. In no event shall the liability of Laura and Melanie Lyne with respect to the Loyalty Program, including liability for negligence or breach of contract, be greater than the Style Rewards accumulated in such Member’s Account at the time the dispute arose.
• 16. Employees, representatives and agents of Laura’s Shoppe (P.V.). Inc. are eligible to participate in the Style Rewards Program, to earn and redeem any Style Rewards.
• 17. Laura Canada (Laura and Melanie Lyne) offers SMS text messaging services for updates on the Style Rewards loyalty program and/or in-store & online promotions. Stay informed about your loyalty points, rewards and exclusive offers. Message frequency may vary. Standard message and data rates may apply. Receiving marketing text messages is not required as a condition of purchase. You can unsubscribe at any time by replying STOP to text messages from Laura Canada.
